By submitting photos or other content, you hereby give Eastern Mountain Sports, its successors, assigns, licensees and legal representatives, the absolute and irrevocable right and permission, to use your name (or any fictional name), picture, likeness, portrait, photograph, quotes, statement(s) or written excerpt(s) or any audio or video recording made of you in all forms and media (which specifically includes internet use and any and all electronic media which now exists and which may exist in the future), and in all manners, including composite or distorted representations, whether produced by standard photographic techniques or computer (hereinafter collectively “Media”), with whatever copy, graphics, or images Eastern Mountain Sports chooses at its sole discretion, worldwide and without restriction as to frequency or duration of use, for any commercial purpose, including, but not limited to, advertising, trade, packaging, point-of-sale materials and/or any other lawful purpose. You waive any right to inspect or approve the finished version(s), including written copy that may be created in connection therewith.
You understand that Eastern Mountain Sports has no obligation to use any or all of the rights granted hereunder.
By agreeing to these terms, you are expressly releasing Eastern Mountain Sports its agents, assigns, directors, employees, legal representatives, licensees, officers and successors and assigns from any and all claims which you may have for invasion of privacy, right of publicity, defamation, copyright infringement, libel, or any other causes of action arising out of the use, adaptation, reproduction, distribution, broadcast or exhibition of such Media.
You certify that you are eighteen (18) years of age or older, have the full right to contract in your own name with respect to the matters stated above, and have no conflicting advertising or promotional commitments which would make you unable to enter into and fully grant the rights specified by this release.
You have read this release and are fully familiar with its contents.
This consent and release shall be binding upon your heirs, next of kin and personal representatives.
Eastern Mountain Sports, its successors and assigns, shall be the absolute owner of any and all Media and materials (and all rights therein, including the copyright) produced pursuant to this release.
